DeviantArt's Flawed Copyright Policy

Tue Jul 3, 2007, 12:44 AM
Recently, 9 of my deviations were stripped down from DeviantArt due to "Copyright Infringement" policies. While I can see the aim of such a policy, it has flaws in the way it is implemented on DA.

1. The Fair-Use legality: Simply put, this means that openly available material that is used in a responsible fashion may be freely redistributed so long as it does not effect the copyright owner's rights to sell or distribute the work. This legality does not mean that the copyright owner can not request the work be removed legally, but doing so is still up to the discretion of the artist/re-distributor and not to a middle-man (such as Deviant Art, acting as a force for a company unaware of any copyright infringement).

2. Deviant Art makes no attempt to background check these "copyright infringements." Instead, it simply removes what it can find under no ground at all besides that it feels it to be right and that they, are in some way, upholding the good of society. Sorry DA, no such luck on most of my art you removed. Almost all of the art that wasn't specifically listed as being freely publishable would fall under the fair-use clause of copyright infringement.

3. Contacting me with an automated bot is USELESS. It makes me have to go through all the work of dealing with a bunch of elitist DA admins that are going to do nothing else but cite policy that isn't even applicable in the situation.

Don't be surprised if this is the last you see from me here as freedom in art and expression is apparently second-hand to website revenue. Pretty pathetic for a premier art-sharing website if I do say so myself.

If memories could be canned, would they also have expiry dates? If so, I hope they last for centuries.
